Hanzebeeld General Terms and Conditions of Travel
These terms and conditions apply to all trips as described on www.hanzebeeld.nl
Article 1. Definitions:
In these general terms and conditions of travel, the terms listed below have the following meanings.
Hanzebeeld, with its registered office at Roggestraat 3, 6981 BJ Doesburg, registered in the Trade Register of the Chamber of Commerce under number: 86626892, hereinafter referred to as: “Hanzebeeld”.
Travel contract: the contract that comes into effect when “Hanzebeeld” receives the booking made by the traveller, whereby “Hanzebeeld” undertakes to provide the traveller with a pre-arranged trip offered by it.
Traveller: the party with whom “Hanzebeeld” has concluded a travel contract, which is subject to the general terms and conditions of travel
Booking form or contract: a (digital) form drawn up by “Hanzebeeld” which the traveller uses to request an organised trip, subject to the terms and conditions of travel applicable at “Hanzebeeld”.
Article 2. Formation of the travel contract:
A booking is final once the (digital) booking form or contract has been received by “Hanzebeeld”. The contract is concluded upon the traveller’s acceptance of “Hanzebeeld”’s offer. The person booking a trip on behalf of other participants is jointly and severally liable for all others they register. When registering a minor, written consent from the legal guardian is required.
Article 3. Payment:
Unless otherwise agreed, a deposit of 50% of the total tour price is payable upon booking (by email confirmation or signed contract). The balance of the tour price must be paid no later than six weeks before departure. If a booking is made for a trip departing within six weeks, payment of the full tour price is due at the time of booking. If the traveller is in default or fails to meet their financial obligations, all reasonable costs incurred in obtaining payment, both in and out of court, shall be borne by the traveller. If the traveller has not met their financial obligations on time, they shall owe interest on the principal sum at a rate of 1% per month for each month or part of a month of delay. Furthermore, he is required to pay collection costs amounting to 15% of the sum claimed, subject to a minimum of €50.
Article 4. Travel sum:
The published tour prices are per person and include only the services and facilities as described in the “Hanzebeeld” packages. The published tour prices are based on the prices, exchange rates, fuel prices, levies and taxes known to “Hanzebeeld” at the time of publication. “Hanzebeeld” reserves the right to increase the tour price in the event of significant price rises. The traveller will be notified of this in writing as soon as possible. In the event of a price increase of more than 10%, the traveller has the right to cancel in writing within 8 days at no cost.
Article 5. Changes made by the traveller:
Any changes made after the booking form has been submitted will, where possible, be accommodated up to 28 days before departure and confirmed in writing by “Hanzebeeld”. A fee of €15 per booking will be charged for any changes. Generally speaking, changes will not be possible from 28 days before the day of departure.
Article 6. Amendments by “Hanzebeeld”:
- In the event of insufficient bookings, “Hanzebeeld” reserves the right to cancel a trip. Naturally, any deposit already paid will then be refunded immediately. One day after the stated booking deadline for the trip, the traveller will receive notification from “Hanzebeeld” as to whether or not the trip will go ahead. If the trip goes ahead, the flight can only be booked at that point. If the traveller books the flight earlier, the risks associated with the trip being cancelled are entirely at the traveller’s own risk.
- The trips offered by “Hanzebeeld” are not set in stone. In other words, we let ourselves be guided by the energy and opportunities of the moment. The programme outlined is a starting point and not set in stone.
Article 7. Travel documents, travel tickets and luggage:
- Passengers must be in possession of all the necessary valid documents at the time of departure. Given the great importance of this, passengers should check the general information provided by “Hanzebeeld” with the relevant institutions and authorities to ensure that it is applicable, complete and up to date.
- “Hanzebeeld” shall not be liable if the traveller is unable to take part in the trip, or parts thereof, as a result of deficiencies in their travel documents.
- The tour operator is not liable for any loss, damage or misplacement of luggage, travel documents, photographic equipment or travel documents.
Article 8. Passport/port of departure requirements
Information regarding the validity of passports or identity cards, as well as airport requirements and conditions relating to luggage, is provided by “Hanzebeeld”, but must always be verified by the traveller with the relevant authorities and institutions. No rights may be derived from the information provided by “Hanzebeeld”.
Article 9. Insurance:
The traveller is required to take out travel and cancellation insurance that also includes assistance from an SOS centre. This is to enable “Hanzebeeld” to provide all necessary and mandatory assistance to travellers in distress.
Article 10. Liability:
“Hanzebeeld” accepts no liability for personal injury or damage to participants’ property, nor any liability arising from events occurring during the trip. If the trip does not meet the expectations that the traveller may reasonably have had under the travel contract, the traveller is obliged to notify “Hanzebeeld” of this as soon as possible. Any damage shall be compensated by “Hanzebeeld” unless the failure to perform is not attributable to “Hanzebeeld” or to any person whose assistance it uses in the performance of the contract, because:
- The failure to fulfil the contract is attributable to the traveller.
- the failure to perform the contract could not have been foreseen or remedied and is attributable to a third party not involved in the provision of the services included in the package.
- The failure to perform the contract is attributable to an event which the tour operator or the person whose assistance is used in the performance of the contract could not have foreseen or prevented, even with all due care.
- Force majeure applies: abnormal and unforeseeable circumstances beyond the control of the party invoking it, the consequences of which could not be avoided despite all reasonable precautions.
If the trip does not proceed in accordance with the expectations that the traveller may reasonably have under the contract due to circumstances for which neither the traveller nor “Hanzebeeld” is responsible, each party shall bear their own losses. “Hanzebeeld” shall never be liable for losses for which a claim for compensation exists under travel and/or cancellation insurance. If “Hanzebeeld” is liable for loss of enjoyment of the trip, the compensation shall not exceed the total cost of the trip.
Article 11. Obligations of the traveler
Any traveller who causes such disruption or inconvenience that it hinders the smooth running of the trip may be excluded from the trip by “Hanzebeeld”. All resulting costs shall be borne by the traveller.
Article 12. Cancellation:
If a contract is cancelled, the traveller is liable to pay the following cancellation fees:
- A 100% cancellation fee applies at all times to any scheduled or charter flights operated by airlines.
- A 100% cancellation fee applies at all times to accommodation and excursions that have already been booked and paid for by Hanzebeeld.
- In all other respects, the following applies:
- Up to 60 days before departure: 25% of the total cost
- From 60 days up to and including 42 days before departure: 35% of the total cost of the trip
- From 41 days up to and including 30 days before departure: 50% of the total cost
- From 29 days to 15 days before departure: 75% of the total cost
- From 14 days up to and including 8 days before departure: 90% of the total cost
- From 7 days before departure: 100% of the tour price
In addition to cancelling, you may send someone else in your place. In that case, it is important that the substitute meets all the conditions set out in the contract and that the request is submitted no later than 7 days before departure. The person who booked the trip, the traveller and the substitute are jointly and severally liable to “Hanzebeeld” for payment of the outstanding portion of the tour price.
Article 13. Complaints procedure:
Any identified shortcoming in the performance of the agreement must be reported to “Hanzebeeld” as soon as possible, so that it can find an appropriate solution. If a shortcoming is not resolved satisfactorily, a written complaint setting out the reasons must be submitted to “Hanzebeeld” no later than one month after your return to the Netherlands. You will then receive a substantive response in writing within 30 days.
Article 14. Dispute resolution:
Notwithstanding the statutory rules governing the jurisdiction of the civil courts, any dispute between “Hanzebeeld” and the traveller shall, where the court has jurisdiction, be settled by the District Court of Alkmaar. “Hanzebeeld” shall, however, retain the right to bring proceedings against the traveller before the court having jurisdiction under the law or the applicable international treaty. All agreements between “Hanzebeeld” and travellers shall be governed by Dutch law.
