Article 1 – General provisions and scope of application
-
These general terms and conditions apply to all agreements between Hanzebeeld and the customer relating to, amongst other things, workshops, photo tours, photo shoots, photography activities, studio hire and the sale of products, unless otherwise expressly agreed in writing.
-
Separate general terms and conditions apply to photography tours. When booking a photography tour, these general terms and conditions therefore do not apply insofar as the general terms and conditions cover the matter in question.
-
By placing an order or booking an activity, the customer confirms that they have read and agree to the applicable terms and conditions.
-
Any deviations from these general terms and conditions are only valid if they have been agreed in writing between Hanzebeeld and the customer.
-
Hanzebeeld reserves the right to amend these general terms and conditions. The terms and conditions to which the customer agreed at the time of entering into the contract shall apply to that contract.
Article 2 – Formation of the contract
-
A contract is formed once the customer has made a booking or placed an order and this has been confirmed by Hanzebeeld.
-
For workshops, photo tours and other activities subject to a maximum number of participants, a participant’s place is reserved once the booking has been confirmed.
-
The customer is responsible for providing accurate contact and personal details when making a booking.
-
Information on the website regarding the content, location, time, what to bring and any requirements for participation forms part of the activity in question.
Article 3 – Prices and payment
-
All prices listed on the Hanzebeeld website are in euros and include VAT, unless expressly stated otherwise.
-
For workshops, photo tours and other activities, the price stated on the website at the time of booking applies.
-
Payment for workshops, photo tours and other activities is to be made at the time of booking using the payment methods offered on the website, unless otherwise agreed in writing.
-
A booking is final once Hanzebeeld has received payment and the participant has received confirmation of the booking.
-
Any costs not included in the participation fee will be clearly stated before the contract is concluded.
-
If Hanzebeeld and the client agree on different payment terms for a photo shoot, commission or other service, the payment terms set out in the relevant quotation or confirmation of order shall apply.
Article 4 – Workshops, photography tours and other activities
-
The content, date, start time, duration, location and any specific conditions relating to a workshop, photo tour or other activity are set out on the relevant page of the website or in the booking confirmation.
-
Hanzebeeld endeavours to carry out the activity as described. Hanzebeeld may amend the programme, schedule, venue or elements of the activity should circumstances make this necessary, for example due to weather conditions, safety, accessibility or the availability of a venue. Hanzebeeld will inform participants of this as soon as possible. If a change substantially alters the nature or content of the activity, Hanzebeeld and the participant will consult to find a suitable solution.
-
If a minimum number of participants applies to an activity, this will be stated in the details of that activity. If the minimum number is not reached, Hanzebeeld may decide not to go ahead with the activity. In that case, the provisions of Article 6 regarding cancellation by Hanzebeeld shall apply.
-
Participants are responsible for arriving at the agreed location on time. Arriving late or missing (part of) the activity does not entitle the participant to a refund or an extension of the activity.
-
Participants are responsible for bringing the photographic equipment, clothing, footwear and other personal items required for the activity, unless it is expressly stated that these will be provided by Hanzebeeld.
-
During the activity, participants must follow reasonable guidance and safety instructions issued by Hanzebeeld and, where applicable, by the owner or manager of a venue.
-
If, due to the nature of the venue or activity, participation in an activity involves specific physical requirements, a dress code, age limits or other conditions of participation, these will be stated in advance for the activity in question.
Article 5 – Cancellation by the participant
-
Cancellations of workshops, photo tours, studio hire or other activities must be notified to Hanzebeeld by email.
-
In the event of cancellation by the participant, the following conditions apply:
-
21 days or more before the start date: a 100 per cent refund of the participation fee paid;
-
8 to 20 days before the start date: a 50 per cent refund of the participation fee paid;
-
7 days or less before the start date: no refund.
-
- A booking or reserved place may be transferred to another person following prior consultation with Hanzebeeld, provided that the replacement customer or participant meets any conditions that apply to the activity, hire or reservation in question.
-
Failure to attend or premature withdrawal by the participant does not entitle them to a refund.
-
In exceptional personal circumstances, Hanzebeeld may, at its own discretion, deviate from the above cancellation terms. No rights may be derived from this for future cases.
Article 6 – Cancellation or amendment by Hanzebeeld
-
Hanzebeeld may cancel a workshop, photo tour or other activity if it is not reasonably possible or justifiable to go ahead with it, for example due to the guide’s illness, the unexpected unavailability of a venue, or other circumstances that prevent the activity from taking place. If a minimum number of participants has been specified in advance for an activity, Hanzebeeld may also cancel the activity if this minimum number is not reached.
-
If Hanzebeeld cancels an activity, the participant will be notified as soon as possible.
-
In the event of cancellation by Hanzebeeld, the participant may choose between:
-
participation in the same or a similar activity on another available date; or
-
a refund of the participation fee paid for the cancelled activity.
-
-
If the participant opts for a refund, the participation fee paid will be refunded within 14 days, using, where possible, the same payment method used for the original payment.
-
Hanzebeeld shall not be liable for any additional costs incurred by the participant in connection with taking part in the activity, such as travel, parking or accommodation costs, unless these costs arise from circumstances for which Hanzebeeld is liable by law.
-
Hanzebeeld may make non-substantial changes to the programme, schedule, route or location before or during an activity if circumstances so require. In principle, such changes do not entitle participants to a refund, provided that the nature and content of the activity remain essentially unchanged.
-
Where circumstances arise that may be regarded as force majeure, the provisions of Article 7 shall also apply.
Article 7 – Weather conditions and force majeure
-
Workshops, photo tours and other activities will, in principle, take place regardless of the weather conditions, unless Hanzebeeld considers that, due to the weather conditions, it is not responsible, safe or reasonably feasible to go ahead with them.
-
Hanzebeeld decides whether weather conditions warrant an activity being amended, rescheduled or cancelled. Where possible, participants will be informed of this as soon as possible.
-
If an activity is cancelled by Hanzebeeld due to weather conditions, the participant may choose either to take part on another available date or to receive a refund of the participation fee paid for the activity.
-
If a participant decides not to take part due to weather conditions, whilst Hanzebeeld goes ahead with the activity, this will be regarded as a cancellation by the participant and the cancellation terms set out in Article 5 will apply.
-
Force majeure is defined as a circumstance beyond Hanzebeeld’s reasonable control which renders the performance of the contract temporarily or permanently impossible or unreasonable.
-
In the event of force majeure, Hanzebeeld will endeavour to provide a suitable solution, for example by rescheduling the activity. If it remains impossible to carry out the activity and no suitable alternative can be offered, the amount paid for the part of the activity that has not been carried out will be refunded.
Article 8 – Participation and safety
-
Participation in workshops, photo tours and other activities must comply with the instructions issued by Hanzebeeld and, where applicable, the owner or manager of the venue.
-
Participants are responsible for assessing whether they are physically capable of taking part in the activity in question. Any special circumstances that may affect their ability to participate safely must be assessed by the participant in advance and, if necessary for the activity to take place, discussed with Hanzebeeld.
-
Participants are responsible for ensuring they have suitable clothing, footwear and personal equipment, unless otherwise stated for the activity.
-
Hanzebeeld may refuse to admit a participant or terminate their participation if they fail to follow safety instructions, endanger themselves or others, cause damage or seriously disrupt the course of the activity.
-
If participation is terminated pursuant to paragraph 4 due to the participant’s actions, there shall be no entitlement to a refund of the participation fee.
-
Participants remain responsible for their own personal belongings and photographic equipment.
Article 9 – Studio hire
-
When hiring the photo studio, the customer books the studio for the agreed date, start time and duration.
-
The tenant is responsible for arriving on time. If the tenant arrives late, the tenancy period will end at the originally agreed time, unless Hanzebeeld expressly agrees to an extension.
-
An extension of the hire period is only possible if the studio is available immediately afterwards and Hanzebeeld agrees to this. Additional charges may apply for any extra usage time.
-
The tenant must use the studio, the equipment provided, the furniture and other facilities with due care and must follow Hanzebeeld’s instructions regarding their use.
-
The tenant is liable for any damage to the studio, its contents or equipment that can be shown to have been caused by the tenant or by persons for whom the tenant is responsible, subject to normal wear and tear.
-
The studio must be left in a reasonable condition after use. If, due to the tenant’s actions, exceptional cleaning or repair work is required, the costs reasonably incurred in this regard may be charged.
-
It is not permitted to use the studio for activities that are unlawful, dangerous or contrary to the intended use of the premises.
-
The tenant is responsible for any guests they bring to the studio during the tenancy period and for ensuring compliance with the applicable house rules and safety regulations.
-
Cancellation or amendment of a studio booking is subject to the cancellation terms set out in Article 5.
-
If Hanzebeeld is unable to make the studio available due to circumstances attributable to Hanzebeeld, a new date will be offered by mutual agreement, or the amount paid for the studio hire that could not take place will be refunded.
Artikel 10 – Fotoshoots
-
